Robert Kyagulanyi’s habeas corpus file has been allocated to a new judge after two declined to handle it.
Justices Esther Nambayo and Musa Ssekaana declined to hear an application filed this morning by former Presidential candidate Robert Kyagulanyi and his wife Barbra Kyagulanyi Itungo seeking their freedom.
The two judges said they are already handling cases involving Kyagulanyi’s National Unity Platform party so in order to avoid conflict of interest they will not handle more related cases.
One of the lawyers Anthony Wameli has revealed that their case has now been allocated to Justice Michael Elubu who has set Thursday, 21st January as date for hearing.
This morning, Kyagulanyi’s lawyers led by Wameli and Geoffrey Turyamusiima filed for a habeas corpus before the High Court in Kampala asking that Kyangulanyi and his wife be produced in court dead or alive for appropriate orders.
The lawyers argue that the continued illegal detention of Kyagulanyi and his wife is an infringement on their rights to personal liberty.
Bobi Wine who came second in the just concluded presidential election, has not left his home which is surrounded by police and army since he went out to vote on Thursday, last week.
He is not allowed to see his friends, lawyers, friends, family and doctors.
