The Constitutional Court has decided to hear a petition challenging the re-appointment of former Chef Justice Benjamin Odoki in the absence of representatives of the petitioner, Gerald Karuhanga.

This is after Karuhanga who is also the Western Youth MP stormed out of court in protest of the judges’ ruling that refused to stay the hearing of the petition.

The judges said there was no order on record asking them to stay the proceedings for the Supreme Court to first pronounce itself on the matter of Justices Steven Kavuma and Augustine Nshiimye being part of the panel.

Five justices of this court led by Remmy Kasule ordered the Attorney General’s representative Wanyama Kadoli  to  present his submissions  after Prof Kanyeihamba directed his team consisting of two other lawyers Nicolas Opio and Emmanuel Orono together with their client Gerald Karuhanga to  walk out of court in protest of the judges’ ruling that refused to stay the hearing of the petition.

Prof. Kanyeihamba was dissatisfied with the unanimous ruling of the justices that they were properly constituted to hear this petition.

The ruling also highlighted that the 2 contentious judges had voluntarily stepped down from the case which paved way for the current panel consisting of Justices Remmy Kasule, Eldard Mwangushgya, Apio Aweri, Solome Balungi Bbosa and Prof. Lillian Tibatemwa to which they do not object.
