The High Court in Kampala is accused of refusing to fix a hearing date for a case involving the First Son Muhoozi Kainerugaba and State House.
The accusation against the court is raised by city lawyer Jackson Ntwatwa who is the complainant in this matter that he filed on May 7, last year.
Muhoozi was sued in his capacity as the commandant Special Forces Command(SFC), an elite military unit under UPDF that guards the First Family and other sensitive installations in the country.
In one of his letters to the Deputy Registrar of the court dated June 18, 2014 Mr.Ntwatwa states that he filed the suit in May 2014 and defenses were filed but to date the matter has not been fixed for hearing.
However, the Judiciary deputy spokesperson Araali Muhirwa, blames the delay on the limited number of judicial staff.
Ntwatwa claims to have been arrested and tortured by some members of the SFC headed by the First Son on October 20, 2012.
He claims his arrest arose from the law suit that he had earlier lodged against the multibillion AYA Hotel over alleged breach of contract.
But Muhoozi’s lawyers of Kiwanuka & Karugire Advocates, argue that the this suit has been wrongly brought against the commandant SFC since it is not an entity with legal capacity to sue or sued.
