The General Court Martial sitting at Makindye has issued an arrest warrant for Nakawa Municipality MP Michael Kabaziguruka after he failed to turn up in court for hearing of the treachery case against him.
The lead prosecutor Maj. Raphael Mugisha has told the 7-member Court chaired by Lt. Gen Andrew Gutti that since Kabaziguruka was released on bail by the High Court last year, he has never turned up for mention of the case before the army court.
Maj.Mugisha explains that the interim order MP Kabaziguruka secured from the Constitutional Court blocking his trial before the army court elapsed when the same court annulled an injunction issued by a single judge and therefore he can no longer use it as a defence not to appear in court.
It is against this background that Maj.Mugisha asked court to order military police to arrest Kabaziguruka since he has been summoned and personally called on phone on 2 occasions but he declined to attend court.
Meanwhile Maj. Mugisha says inquiries into this case against Kabaziguruka and 25 others are complete but hearing cannot kick off in the absence of one of the accused persons.
Kabaziguruka who has since challenged this trial in the Constitutional Court was arrested in June last year and charged with Treachery and offences relating to security in which the prosecution says he connived with serving UPDF soldiers to infiltrate security by engaging in war like activities with an intention of overthrowing the government of Uganda.
