The Catholic Church has won a land case in which a family was seeking an interim injunction halting the construction of Martyrs’ Shrines in Munyonyo ahead of the Pope’s visit.
Fredrick Kato Mazinga Serwano had filed a case before the High Court, accusing the church of trespass on his land on block 255 plot 124 located in Munyonyo Kampala.
Mazinga claimed that the church fraudulently acquired the seven acre piece of land, which he inherited from his grand- father Serwano Mazinga.
Court documents show that the disputed land was donated to the church by a one Christina Namukasa in 1983 yet the plaintiff’s grand-father Serwano Mazinga died in 1923.
Justice Alfonse Owiny Dollo noted that the land had been transferred in several names before the church acquired it and since court never cancelled these other several transfers, the church was never aware of any fraud.
The plaintiff Fredrick Mazinga Kato has been ordered to pay the church Shillings 5 million for the inconveniences caused ahead of Pope’s visit.
