Three justices of the Appeal court have confirmed the victory of Paul Nsubuga as the elected member of Parliament for Busiro North Constituency.
This is after the three led by Justice Deputy Chief Justice Richard Buteera dismissed the appeal filed by Nsubuga’s political rival Edgar Lubadde challenging the decision of Justice Winfred Nabisinde that dismissed his petition for the lack of evidence.
In their appeal read by Court’s registrar Lillian Buchana, the justices first dismissed an Application also filed by Lubadde asking the court to give him time to serve Nsubuga’s lawyers with the appeal.
DP’s Edgar Lubadde who also came last in the 14th January 2021 polls for Busiro North Constituency dragged MP Nsubuga to Court accusing him of lacking the requisite academic qualification of A’ level and impersonation.
Lubadde told the court that although the legislator contested as Nsubuga Paul, his real name is Mukalazi Peter, and his traceable academic journey ended at Primary Leaving Examinations.
He adds that thereafter, Mukalazi fraudulently usurped a UPDF scholarship solely meant for the children of army personnel, and to achieve this, he reportedly had to change his name from Mukalazi Peter to Nsubuga Paul, and the name of his father Mathias Kibuuka to Charles Mbabaali who was UPDF soldier.
