The case in which former Vice President prof. Gilbert Bukenya is accused of grabbing another man’s wife has taken a new twist.

Bukenya’s lawyers led by Macdusman Kabega have asked court to withdraw the case or to refer it to the constitutional court for interpretation.

Kabega argued that anything to do with the interpretation of an act must be done by the Constitutional Court not  the family division.

In July 2012 Emmanuel Nyabayango took Bukenya and his former wife Margaret Kabasinguzi to the family division of the High court seeking a declaration that Bukenya’s act of seducing and fathering a child with a married woman was in violation of the Constitution.

Bukenya also says that in July 2009 they reached an agreement and Nyabayango was paid shs 150m, but Nyabayango contends that the money was to keep the matter away from the press not compensation as Bukenya alleges.

The family division judge Percy Tuhaise has set July 1st as the date for ruling.
