Mathiew Kanyamunyu a key suspect in Lugogo Forest Mall shooting has re-applied for bail.
The application has been allocated to High Court Judge Elizabeth Kabanda who is yet to fix a hearing date.
Matthew Kanyamunyu , his girlfriend Cynthia Munwangari and his elder brother Joseph Kanyamunyu are charged with murder of social worker Kenneth Akena on the 12th/November 2016 at Lugogo Forest mall.
This is the second application filed by the trio seeking to be released on bail sighting their constitutional right and the presumption of innocence until proven guilty by court.
On 10th January 2017 the same judge Elizabeth Kabanda dismissed the trio’s bail applications on grounds that they have not proved to court exceptional circumstances of ill health or advanced age which cannot be handled at Luzira prison where they are currently held.
She ruled that even though the accused had presented substantial sureties, the DPP should be given a chance to complete the investigations and have the accused committed for trial before the High court.
Now, since the accused has already committed to High Court for trial, they have again re-applied seeking the same recreation.
